Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the HireAI platform (“Platform”), operated by MOHAN DRESSES (“we,” “our,” or “us”). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Parties & Definitions

  • "Platform" — the HireAI software-as-a-service application available at myinterviewhelper.com and related subdomains.
  • "Operator" — MOHAN DRESSES, the legal entity that owns and operates HireAI, with registered address at 753, FUHARA, LORDGANJ, JABALPUR, Jabalpur, Madhya Pradesh 482001, India.
  • "Client" — any company, recruiter, staffing agency, or individual who creates an account and uses the Platform.
  • "Candidate" — a job seeker who is contacted by a Client through the Platform.
  • "WABA" — WhatsApp Business Account owned and registered by the Client.
  • "Meta Platform Data" — any data received from Meta's APIs, including Facebook Business IDs, WABA IDs, access tokens, and message content.

2. Description of Service

HireAI is an AI-powered recruitment platform that acts as a Tech Provider enabling Clients to use their own WhatsApp Business Account (WABA) to communicate with job candidates at scale.

The Platform provides tools including but not limited to:

  • WhatsApp Business Embedded Signup — to connect the Client's own WABA to the Platform
  • AI-powered candidate outreach via Meta-approved message templates
  • Inbound message processing and AI-generated replies via the Client's WABA
  • AI voice screening via supported third-party voice providers
  • AI candidate match scoring and pipeline management
  • A talent database (CRM-grade candidate profiles)

The Platform does not send messages using its own WhatsApp number. All outbound and inbound WhatsApp communications flow through the Client's own verified WABA.

3. Eligibility & Account Registration

To use the Platform, you must:

  • Be at least 18 years of age
  • Be a registered business or acting on behalf of a registered business
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Have an active WhatsApp Business Account registered with Meta

You are responsible for all activity that occurs under your account. Notify us immediately at karanpeshwani7@gmail.com if you suspect any unauthorised access.

4. Acceptable Use

You agree to use the Platform solely for lawful recruitment purposes and in compliance with all applicable laws. You must:

  • Use the Platform only to contact candidates who have given valid opt-in consent to receive WhatsApp messages
  • Comply with WhatsApp's Business Policy and Commerce Policy at all times
  • Use only Meta-approved message templates for the first outreach message
  • Not use the Platform to send spam, unsolicited messages, or promotional content unrelated to recruitment
  • Not misrepresent your identity or your business to candidates
  • Comply with all applicable data protection laws, including the Digital Personal Data Protection Act (DPDP Act, India) and GDPR where applicable

5. WhatsApp Business Obligations

As a Client using the Platform's WhatsApp integration, you are solely responsible for:

  • Obtaining and documenting valid opt-in consent from every candidate before initiating WhatsApp contact
  • Ensuring your WhatsApp Business Account remains in good standing with Meta
  • Ensuring your message templates comply with Meta's template guidelines
  • Managing opt-outs and honouring candidate requests to stop receiving messages
  • Not using the Platform to send messages to emergency services, minors, or individuals on do-not-contact lists
ImportantMOHAN DRESSES / HireAI is a Tech Provider and does not control whether candidates have consented to receive your messages. This responsibility rests entirely with the Client.

6. Meta Platform Data

When you connect your WABA to the Platform via WhatsApp Business Embedded Signup, we receive Meta Platform Data including your Facebook Business ID, WABA ID, Phone Number ID, and access tokens.

We use this data exclusively to provide the recruitment messaging service described in Section 2. Specifically, we:

  • Use access tokens only to send and receive messages on your behalf via the WhatsApp Cloud API
  • Do not sell, license, or transfer Meta Platform Data to any third party
  • Do not use Meta Platform Data for advertising, profiling, or any purpose unrelated to your recruitment campaigns
  • Revoke and delete your access tokens promptly upon account termination or integration disconnection

Our use of Meta Platform Data is governed by Meta's Platform Terms and Developer Policies.

7. Prohibited Uses

You must NOT:

  • Re-sell, sublicense, or transfer access to the Platform or Meta Platform Data to any third party
  • Use the Platform to conduct mass unsolicited messaging (spam)
  • Attempt to bypass, hack, or reverse-engineer any part of the Platform or the WhatsApp Cloud API
  • Use the Platform to collect candidate data for any purpose other than recruitment
  • Combine Meta Platform Data with other datasets to build advertising or profiling products
  • Use the Platform in any way that violates Meta's Platform Terms, Developer Policies, or WhatsApp Business Policy
  • Use the Platform for any illegal purpose or in violation of any applicable law

We reserve the right to immediately suspend or terminate accounts found in violation of these prohibitions without prior notice.

8. Subscription & Payment

Access to the Platform is provided on a subscription basis. By subscribing, you agree to:

  • Pay all applicable fees in advance for the subscription period selected
  • Provide accurate billing information and keep it current
  • Authorise recurring charges for auto-renewed subscriptions unless cancelled before the renewal date

Subscription fees are non-refundable except where required by applicable law. We reserve the right to change pricing with 30 days' notice to active subscribers. Enterprise plans are governed by a separate written agreement.

9. Intellectual Property

All intellectual property in the Platform — including software, AI models, UI, branding, and documentation — is owned by MOHAN DRESSES. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Platform for your internal recruitment operations only.

You retain ownership of your own data (candidate records, job descriptions, conversation history). You grant us a limited licence to process this data solely to provide the service.

10. Disclaimers & Limitation of Liability

The Platform is provided “as is” and “as available.” We make no warranties, express or implied, regarding the Platform's fitness for any particular purpose, uninterrupted availability, or accuracy of AI-generated outputs.

To the maximum extent permitted by applicable law, MOHAN DRESSES shall not be liable for:

  • Any indirect, incidental, consequential, or punitive damages
  • Loss of business, revenue, data, or goodwill
  • Any harm arising from a Client's failure to obtain candidate consent before messaging
  • Any suspension or action taken by Meta against a Client's WABA
  • AI model outputs, including screening scores or generated messages

Our total aggregate liability for any claim shall not exceed the amount paid by you to us in the three months preceding the claim.

11. Termination

Either party may terminate these Terms at any time. We may immediately suspend or terminate your account if you:

  • Breach any provision of these Terms
  • Violate Meta's Platform Terms or WhatsApp Business Policy
  • Fail to pay subscription fees when due
  • Engage in fraudulent or illegal activity

Upon termination, your access to the Platform will be revoked, your WABA integration will be disconnected, and all your data will be deleted within 30 days unless a longer retention period is required by law.

12. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Jabalpur, Madhya Pradesh, India.

We encourage you to contact us first to resolve any dispute amicably before initiating legal proceedings.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Notify active Clients via email or an in-platform notification at least 14 days before changes take effect

Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
